The limitations and exclusions also apply if this remedy does not fully compensate you for any losses or fails of its essential purpose.

The formation, interpretation, and performance of this Agreement and any disputes arising out of it shall be governed by the substantive and procedural laws of São Paulo, Brazil without regard to its rules on conflicts or choice of law and, to the extent applicable, the laws of Brazil. The exclusive jurisdiction and venue for actions related to the subject matter hereof shall be the courts located in São Paulo, Brazil, and you hereby submit to the personal jurisdiction of such courts. You hereby waive any right to a jury trial in any proceeding arising out of or related to this Agreement. The United Nations Convention on Contracts for the International Sale of Goods does not apply to this Agreement.

Este regulamento contém as informações básicas e regras aplicáveis ao Hackathon Tray + All iN e colocamos a disposição dos candidatos e futuros participantes para entendimento e direcionamento de toda realização do evento. Portanto, os candidatos/participantes, no ato de seu cadastro e inscrição aderem integralmente a todas as suas disposições, declarando que aceitam todos os termos deste regulamento.
Esta campanha é promovida pelo Polinize Soluções Tecnológicas LTDA, com sede na cidade de São Paulo, Estado de São Paulo, na Rua Liceu, 172, Parque da Lapa, no CEP 05.301-030, inscrito no CNPF/MF sob o nº 17.812.670/0001-05
Desafio: Como captar os dados do mundo digital para serem utilizados no mundo físico trazendo uma melhor experiência para o consumidor nessa jornada online?
1.1. Para o fim do disposto neste REGULAMENTO serão adotadas as seguintes definições:
2.1. A edição Online do Hackathon tem como objetivo promover e avaliar a seleção das melhores soluções tecnologias desenvolvidas pelos PARTICIPANTES com a finalidade de conectá-los com o PROMOTOR.
3.1. O Hackathon acontecerá nos dias 04/12/2020 a 06/12/2020.
3.2. O evento será realizado integralmente online.
4.1. Podem efetuar a pré-inscrição para o Hackathon pessoas físicas com idade igual ou superior a 18 (dezoito) anos, desde que aceitem os termos deste referido documento.
4.2. É permitida somente 01 (uma) pré-inscrição por CPF (pessoa física).
4.3. As pré-inscrições se darão no período de 09/11/2020 até 02/12/2020 às 23h59, por meio do preenchimento de todos os campos obrigatórios no formulário eletrônico de pré-inscrição.
4.4. As pessoas pré-inscritas deverão ter conhecimento e/ou experiência em, pelo menos, 01 (uma) das áreas elencadas abaixo. Não é obrigatório ter habilidade em todas as áreas:
4.5. O preenchimento e envio do formulário eletrônico de pré-inscrição não garante a participação da pessoa inscrita no Hackathon Tray + All iN.
4.6 Os interessados em participar do Hackathon precisam formar times que tenham entre 3 (três) a 5 (cinco) participantes.
5.1. Todas as pré-inscrições, desde que realizadas dentro do prazo indicado para inscrição, serão avaliadas pela Comissão Organizadora do Evento.
5.2. As pessoas pré-inscritas passarão por uma seleção de avaliação de perfil, conforme critérios estipulados no item 4.4, 4.5, 4.6 e outros quesitos que as pessoas integrantes da Comissão Organizadora entenderem pertinentes.
5.3. Todas as pessoas que se candidataram serão comunicadas sobre a decisão do processo seletivo pela Comissão Organizadora até o dia 02 /12/2020, de forma definitiva.
5.4. As decisões da Comissão Organizadora do Evento quanto à aprovação/reprovação das pessoas candidatas na fase de seleção são soberanas. Desse modo, não cabe qualquer tipo de recurso e/ou reclamação de pessoas pré-inscritas contra estas decisões.
6.1. As pessoas cuja candidatura for aprovada na fase de seleção deverão confirmar a presença, na forma e no prazo a serem definidos pela Comissão Organizadora, para efetivamente participar do evento.
6.2. A participação no Hackathon é voluntária, gratuita, nominativa e intransferível.
6.3. As pessoas participantes competirão em equipes formadas de 03 (três) a 05 (cinco) integrantes, devendo sempre ser observado o tema macro desta edição.
6.4. No que se refere à formação das equipes:
7.1. A programação do Hackathon compreende ideações, sessões de mentorias, oficinas e avaliações para a seleção das melhores soluções desenvolvidas. A programação completa será divulgada no início do evento e estará disponível no site: hackathon.polinize.com
8.1. A submissão de projetos do Hackathon deverá ser entregue através do e-mail [email protected] com o campo assunto preenchido da seguinte maneira Hackathon + nome do grupo até às 23:59 do dia 06/12/2020 (Domingo) e da seguinte forma:
9.1. No dia 07/12/2020 ao dia 09/12/2020, no horário que constar na programação do evento, as equipes participarão da banca avaliadora. Esta banca será convidada pela Comissão Organizadora e fará as análises e avaliações para validar a melhor solução do desafio.
9.2. Para referida análise, serão considerados os seguintes pontos:
10.1. No dia 10 de Dezembro de 2020, no encerramento do Hackathon, de acordo com a programação, será realizada uma Live no Canal da Polinize no Youtube com a cerimônia de premiação.
10.2. Serão premiados os integrantes da equipe vencedora que tiver a maior nota, elencado na média, em todos os critérios conforme decidido pela Organização, seguindo os termos deste regulamento, fazendo jus ao seguinte prêmio, pagos na modalidade de brindes para o PARTICIPANTE, sendo:
• 1º lugar: 1 cadeira gamer + 1 mochila com brindes da Tray e All iN para cada integrante da equipe.
• 2º lugar: 1 Kindle + 1 mochila com brindes da Tray e All iN para cada integrante da equipe.
• 3º lugar: 1 mochila com brindes da Tray e All iN para cada integrante da equipe.
10.3. Todos os prêmios oferecidos às pessoas integrantes do time são pessoais e intransferíveis.
10.4. Poderá participar da promoção qualquer consumidor residente e domiciliado em território nacional;
10.5 Os prêmios serão entregues em até 45 dias da data da apuração por correio, sem qualquer ônus aos contemplados.
11.1. Como padrão de ética e de forma a garantir a imparcialidade, as pessoas integrantes que farão parte das bancas julgadoras comprometem-se a informar à Comissão Organizadora qualquer conflito de interesse na avaliação da solução desenvolvida, assim que for identificado.
12.1. Em todas as etapas do Hackathon, a Comissão Organizadora se comunicará com os participantes inscritos preferencialmente, por meios eletrônicos: e-mail e site ou através do canal oficial do Hackathon no Discord App.
12.2. Os participantes inscritos são responsáveis por acompanhar a programação, os resultados e eventuais alterações do evento.
14.1. As datas do período de pré-inscrições e de divulgação dos participantes, cujas inscrições forem deferidas, poderão ser prorrogadas, a critério da Comissão Organizadora. Nessa hipótese, será dada publicidade das alterações feitas, por meio do endereço do site.
14.2. O Hackathon será coordenado por uma Comissão Organizadora que irá designar e convidar pessoas mentoras e pessoas avaliadoras que farão parte das bancas julgadoras.
14.3. Os participantes também autorizam a utilização de todos os dados fornecidos no momento da pré-inscrição, apenas para fins não comerciais, pelo Hackathon.
14.4. As pessoas participantes se responsabilizam pela originalidade de todo conteúdo por eles produzidos no âmbito do presente Regulamento, respondendo integral e exclusivamente por eventuais danos ou ônus a terceiros, excluindo e indenizando o Hackathon e seus organizadores, em caso de demanda judicial ou extrajudicial intentada por terceiros, sob qualquer alegação relacionada à violação de direitos de propriedade intelectual, industrial, patentes, imagem, voz e nome.
14.5. Suspeitas de conduta antiética, do não cumprimento deste Regulamento, das normas internas dos espaços nos quais ocorrerá o evento, serão analisadas e julgadas pela Comissão Organizadora, podendo ainda resultar na desclassificação do respectivo participante.
14.6. Não serão aceitas nenhuma atitude racista, machista, homofóbica e/ou preconceituosa de qualquer gênero. Se identificada a situação será analisada pela Organização, podendo ocasionar na desclassificação e expulsão dos participantes.
14.7. Não serão aceitas soluções copiadas ou reproduzidas, de forma total ou parcial, de outras fontes e/ou competições. A identificação de uma cópia, total ou parcial, será punida com a desclassificação do respectivo participante.
14.8. As decisões das pessoas integrantes da banca avaliadora no que tange à seleção e à premiação das equipes participantes, além das decisões que a Comissão Organizadora venha a dirimir, serão soberanas e irrecorríveis, não sendo cabível qualquer contestação das mesmas, bem como dos seus resultados.
14.9. O Hackathon tem finalidade exclusivamente cultural, visando reconhecer e divulgar as soluções desenvolvidas que tenham potencial inovador, estimulando a difusão do tema no meio empresarial, não possuindo caráter comercial, não estando condicionada, em hipótese alguma à sorte, nem objetivando resultados financeiros, e não implica em qualquer ônus de qualquer natureza para as pessoas participantes inscritas e para as pessoas premiadas ao final do concurso, além de não vincular a participação à aquisição, uso e/ou compra de produtos ou de serviços da entidade organizadora ou dos parceiros.
14.10. O Hackathon a seu exclusivo critério, poderá, a qualquer tempo, se julgar necessário, alterar as regras deste Regulamento, suspender a realização do evento, assim como substituir qualquer um dos prêmios por outros de igual valor, mediante comunicação no site do evento.
14.11. O evento poderá ser interrompido ou suspenso por motivos de força maior ou devido a problemas de acesso à rede de Internet, com servidores, entre outros, não sendo devida qualquer indenização ou compensação às pessoas participantes do concurso e/ou aos eventuais terceiros. O Hackathon enviará, nesses casos, os melhores esforços para dar prosseguimento ao evento tão logo haja a regularização do problema, resguardando-se, no entanto, a possibilidade de cancelamento definitivo, na hipótese de impossibilidade de sua realização.
14.12. Os casos omissos não previstos neste Regulamento serão julgados pela Comissão Organizadora.
14.13. As pessoas participantes detêm todos os direitos de propriedade intelectual assegurados pela legislação brasileira que recaiam sobre o código fonte desenvolvido para o desafio.
14.14 A mera participação nesta do candidato caracteriza conhecimento e aceitação total e irrestrita de todos os termos e condições previstas no presente REGULAMENTO, servindo, ainda, como declaração de que não estão esses impedidos, por qualquer razão, de receber e/ou usufruir os prêmios concedidos.
14.15. Este regulamento não implica qualquer modalidade de sorteio, distribuição ou operação assemelhada na forma da Lei nº 5.768/71, não estando desta forma sujeita à autorização prévia estabelecida nessa legislação.
14.16 A Hackathon não se responsabiliza por eventuais danos decorrentes de problemas de ordem técnica, alheios a sua vontade, relacionados a falhas de comunicação em função da incompatibilidade de sistemas operacionais ou em decorrência de qualquer problema relativo à telecomunicação, inclusive à indisponibilidade temporária do sistema da mesma; interrupção da deste regulamento por problemas de acesso à rede de Internet, intervenção de hackers, vírus, manutenção, queda de energia, falha de software ou hardware, bem como por caso fortuito ou força maior. Em tais hipóteses, a Hackathon não estará obrigada a prorrogar o período de participação.
14.17 O descumprimento de quaisquer dos termos do presente Regulamento acarretará a exclusão imediata do candidato.
14.18 Os candidatos, mediante o seu cadastro, autorizam a Hackathon e a Polinize de forma gratuita, independentemente de qualquer ônus, em caráter irrevogável e irretratável, a utilizar seu nome, imagem e som de voz pelo para fins de divulgação desta campanha, pelo prazo de 01 (um) ano, em quaisquer canais de comunicação, redes sociais, no Brasil e/ou no exterior, a exclusivo critério da Hackathon.
14.19 A participação na presente campanha não gera qualquer outro direito aos participantes além dos expressamente estabelecidos neste Regulamento, uma vez cumpridas as suas exigências.
14.20 A responsabilidade da Hackathon limita-se às responsabilidades expressamente previstas no presente Regulamento.
14.21. Fica eleito o Foro da Comarca de São Paulo, Estado de São Paulo, com expressa renúncia de qualquer outro, por mais privilegiado que seja, para dirimir eventuais dúvidas, pendências e litígios oriundos deste Regulamento, quando não solucionados nos termos expressos acima.
